MEDIATION:Our office can provide complete mediation and/or dispute resolution services for both Family and Civil Mediation. The firm offers mediation rooms as well as Rule 31 mediators in both types of mediation. Family Mediation:Standards for divorce mediation and mediators have been set by the Association of Family Mediators, the America Bar Association and the Tennessee Legislator.T.C.A.§ 36-4-131 and § 36-6-107 and 305, sets out specifics for Family mediation in cases that involve domestic abuse. These services require the mediator to have special domestic violence mediation training. T.C.A. § 36-6-401, et. seq., discusses the requirements and purposes of the dispute resolution process. Mediation or dispute resolution is a process that is required in most custody matters, whether in a divorce case, modification of custody and/or visitation or paternity action. Though mediation is usually required to resolve disputed parenting questions, the mediation process only mandates a good faith effort to resolve the issues. Civil Mediation:Mediation is a common process used to resolve a fast array of civil disputes. Rule 31 Civil mediators are required to have a specific certification and qualifications as set out by law. |
